Title: 27 Wilson Court Ms. Catherine Powell, Municipal Prosecutor, identified herself as the representative on behalf of the City of Barrie. Ms. Powell called the Appellants' names, Iryna Litovchenko and Yevgeniy Borysenko, three times in the hallway and the Council Chambers with no response. The Chair, Stephen Kinsella, explained that pursuant to By-law 2011-138, Section 7.1 of Appendix "A", the Rules of Procedure of the Property Standards By-law indicates, "Where a person is properly notified of a hearing and does not attend at the time and place of a hearing and does not attend at the time and place appointed, the Commission may proceed in that person's absence and without further notice to that person". The Chair advised that pursuant to By-law 2011-138, Section 7.1, the hearing shall proceed in the absence of the Appellant. Ms. Powell clarified with Canina Paoletti, Property Standards Officer, the status of the items list on Property Standards Order PSC25-00279. Ms. Paoletti advised that the Appellants have been compliant with the majority of the items that were listed in the Order, except the outstanding items that are subject to the appeal. She noted that the items under appeal are significant deficiencies. She further advised that, after recently speaking with the Appellants regarding the status of the retaining wall and fencing, she would be agreeable to an extension of time for the Order.

Ms. Powell advised that, given the supporting documentation in relation to Property Standards Order PSC25-00128 submitted by the City and provided to the Committee, the position is to uphold the Order in whole with additional time granted for compliance or to adjourn a decision to the September 25, 2025, Property Standards Committee meeting.

The Chair advised that the Committee has made a decision with respect to the appeal by Iryna Litovchenko and Yevgeniy Borysenko.
