“5 a) Notwithstanding the development charges set out in Schedules “B-1” to “B-5”, the first 1.2 million sq ft of non-residential, non-retail space for which building permits are issued shall be subject to the rates set out below, such rates to be subject to the annual indexing set out in section 7:
