TMP-34340 2  Item of Discussion177 Bayview Drive, Unit 47 Ms. Catherine Powell, Municipal Prosecutor, identified herself as the representative on behalf of the City of Barrie. Mr. Martin Zarnett identified himself as the representative on behalf of the Appellants, 177 Bayview Drive Ltd. c/o Realstar Corporation. Ms. Powell addressed the Chair to request a brief ten-minute recess to discuss and clarify information pertaining to the Property Standards Order PSC25-00082. The Chair granted the request for a ten-minute recess. The Property Standards Committee meeting recessed at 6:03 pm. and resumed at 6:10 pm. Ms. Powell explained that she met with Mr. Zarnett and discussed information related to the timeline of the Appellant’s property, 177 Bayview Drive, Unit 47, which is before the Landlord and Tenant Board. She advised that after discussions of the timelines, both parties are in agreement to adjourn the matter until September 25, 2025. TMP-34341 2  Item of Discussion226 Foster Drive Ms. Catherine Powell, Municipal Prosecutor, identified herself as the representative on behalf of the City of Barrie. Mr. Pouya Kakaee identified himself as the Appellant in the matter. Ms. Powell asked the Committee for a brief ten-minute recess to try to reach an agreement with the Appellant, Mr. Kakaee. The Chair granted the request for a ten-minute recess. The Property Standards Committee meeting recessed at 6:27 pm. and resumed at 6:35 pm. Ms. Powell advised the Committee that both parties spoke and were putting forward a joint submission to uphold the order in full and give additional time to have the work completed. The date provided was July 9, 2025, in which the Appellant must contact Property Standards Officer to let them know the work has been completed. Mr. S. Kinsella, Chair of the Property Standards Committee advised that the Committee had made a decision regarding the appeal by Mr. Kakaee. TMP-34342 2  Item of Discussion228 Dunlop Street West Ms. Catherine Powell, Municipal Prosecutor, identified herself as the representative on behalf of the City of Barrie. Ms. Powell called the Appellant's name, Vinod Kumar, three times in the hallway and the Council Chambers with no response. The Chair, Stephen Kinsella, explained that pursuant to By-law 2011-138, Section 7.1 of Appendix “A”, the Rules of Procedure of the Property Standards By-law indicates, “Where a person is properly notified of a hearing and does not attend at the time and place of a hearing and does not attend at the time and place appointed, the Commission may proceed in that person’s absence and without further notice to that person”. The Chair advised that pursuant to By-law 2011-138, Section 7.1, the hearing shall proceed in the absence of the Appellant. Ms. Powell advised that, given the supporting documentation in relation to Property Standards Order PSC25-00128 submitted by the City and provided to the Committee, the position is to uphold the Order in whole with no additional time granted for compliance.
